Dear All mentors, One of my female friends asked me that her company is not giving her benefits of maternity.
Her maternity period is now over and the company didn't give her any benefit of maternity. She is an account assistant in Textile company with approx 500 manpower.
Can She Claim now the benefits of maternity after 01 year of maternity?

Did your friend applied for maternity benefit?
Did employer denied to extend the same as to claim of your friend?
There need to raise complaint before labour office by your friend for her rights under the act.

Year Sir, She had applied and they denied it verbally. There is no written procedure completed to deny her request so she is not having any proofs now for the same.

The Maternity Benefit Act 1961 makes it explicit that the maternity benefit is a right of the women employee and the employer is obliged to provide it. Since the claim for the benefit has been made as per the Act in the event of refusal (as is evident), the claim could be sent to the Inspector (Labour Officer of the local area) and he is required to take further action.
