Hi ! I am working in a private company as a HR trainee. I have a query. There is an employee whose contract itself is ending on June 30, 2020 without any further extension. Should the employee be asked to serve notice period? Kindly advise.

Hi SSR,
Strictly there is no need to issue a notice of termination as the contract itself coming to a close by 30th June. However as a courtesy, nothing wrong in 'intimating' about the closure of contract, mentioning no extension is being thought of. It cannot sound as a 'Notice' or a notice period.

You need not ask him to serve notice period. As validity of his contract comes to a close on 30th June, it shall automatically be terminated. Notice period is required only in case where the contract needs to be terminated before the actual expiry of contract of services.

The question of 'Notice Period' comes, if the contract having the term to serve 'Notice Period' and leaving prior to end of contract date.
As a courtesy of good gesture inform the employee that his contract is ending on June 30, 2020 without any further extension owing to present situation by calling to him to office.

If you want to dismiss staff or your employee wants to resign, a period of notice should be given in both situations. There is a minimum period of notice which can be given and rules to address any conflicts that may arise-Read this article -https://rplg.co/71b89e00
