Hi all, Hope you are doing good !!

My Queries :

1) If an employee who is in the Other State and his company situated in another state as per state and central govt orders in COVID-19 lockdown time he/she not supposed to cross their borders interstate movement will not accepted by the government, so the company comes under essential commodity manufacturing company, employer cannot able to assign the workfrom home also becuase the particular employees comes under production related works so the employer need to pay full salary for them ?

2) The employees who stays in the same state and providing cab facility for them ,even though the particular employee not attending to their duties by comparing the other employees who are not able to attend their duties due to the lockdown for them the employer wants to pay full salary or not, or else the employer can take any neccessary actions on this ?

3)Is their any mandatory to provide extra salary who are attending their works in the lockdown also ?

Legally an employee is supposed to be in the head quarters. In the case of an establishment manufacturing essential commodities all the employees are expected to be available in the same place where the company functions. If any employee is stranded in a red zone/ locked down area, it is upto him to reach the place of work. If not reported to work due to lock down, the employer cannot be forced to pay salary.
If the employees who stay in the place of work refuses to come for work despite arranging cab, very strict disciplinary action should be taken against such employees. They cannot say that some others are not reporting and therefore we should also stay at homes.
Nobody should be allowed to take advantage of lock down. If somebody (our own colleague) could not come for work, how can a genuine employee ask for extra remuneration? My factory is working in 50% capacity for want of achieving social distancing policy. But many of us come to office every day, because some are stranded at red zones and we cannot call them and to made it up we come on a daily basis. It is a mutual arrangement. How can I demand any additional remuneration? One should remember that all this happened not due to employer but things went so due to reasons beyond our control. In such scenario we should help each other.
