Now is employer liable to pay double pay / additional leave if they work from on May 1st. Your suggestion and inputs are appreciated.

The question of grant of alternative holiday or payment of double wages would arise only when the employee is asked by the employer to work on a national or festival holiday fixed. Work from home on any day including the current lock down spell is no doubt a working day only. If that particular day is a national or festival holiday and the employer asks to work from home on such day, the provisions relating to double wages or alternative holiday would certainly apply irrespective of the place of work on that day is the premises of the establishment or elsewhere.

You see the rule of your state deals with NH & FH, act accordingly. The question of grant of alternative holiday or payment of double wages would arise only when the employee is asked by the employer to work on a national or festival holiday.
You need to pay as per the rule of state, if on day of FH/NH the employee has performed his duty. If, it is work from home applies to the employee in the current lock down treated as on duty.

First of all 1st May is not a National Holiday. Need to follow the state guidelines for 1st May, if any. Whether your establishment considered as holiday in the notified list of holidays during this calendar year. The establishment can work on a holiday by paying as per the state rule for working on holidays. There are many establishments can not be closed completely because of their operational process.
