I have 2 units in Gurgaon where in one i create hampers for sale and in next i do labelling packaging. Pls advice if we would fall under factories act or as manufacturing unit?
Dear Aakriti,
Plz go through the definition of manufacturing process under Factories Act, 1948 which is given hereunder for ready reference & if it is so then if you are employing 10 more workers including contractor workers & is using power then you are covered under this Act.
Sec 2(k) "manufacturing process" means any process for-
o (i) making, altering, repairing, ornamenting, finishing, packing, oiling, washing, cleaning, breaking up, demolishing or otherwise treating or adopting any article or substance with a view to its use, sale, transport, delivery or disposal; or
o (ii) pumping oil, water, sewage, or any other substance; or
o (iii) generating, transforming or transmitting power; or
o (iv) composing types for printing, printing by letter press, lithography, photogravure or other similar process or book-binding; or
o (v) constructing, reconstructing,, repairing, refitting, finishing or breaking up ships or vessels; or
o (vi) preserving or storing any article in cold storage ;
