As per your mail, you have said that you have worked for 9 years. In these nine years are you having a salary structure of a consultant mode (i.e.) conslidated pay or a salary structure with basic, hra & pf etc.
If you have a salary struture of option 2 then you are eligible.
The gratuity amount is calculated:
basic/26*15*no:of years.
Please refer gartuity act, 1972 avail. in website

Whether it is Private Limited, Partnership firm or Propreitorship the Gratuity Act will apply if they are employed more than 10 members. The designation is not the issue. If any body taking salary as Consultant as a fixed amount then he is not eligible for Grauity if he completed more than 5 years as Consultant or Advisor etc.
In other cases with designation as Consultant or with any designation if they provide salaryslip or taking the signature in salary Register showing Basic+DA+HRA+Conveyance etc. and employee completed more than 5 years then he is eligible for Gratuity. For example total service is 5 years 6months and 10 daysfor calculation of gratuity is 6 years.

Dear Member,
If the gratuity is denied, a person can make a claim before the Commissioner for Gratuity not before the labour court. Labour court can resolve industrial disputes as defined under schedules of the ID Act.
