Dear Friends,
I am working for one of the private company where a female staff is covering under ESIC scheme.
we have made a mistake while updating her Existing Esi Ins number with our company at the time of joining.
i.e example: her previous company no : 5122862015, but we wrongly updated it has 5122862026( last digit is typically errored)
Because of this, the entire last 1.2 years contribution paid to a other unknown person who is male.
Now she is under a maternity leave and want to get a maternity benefit. When we approched ESI officials they are not responding properly.
We have all the proof for wrong remittance of monthly contribution.
We are in need of good guidance in this for reclaiming her maternity benefit 182 wages.
Thanks

So, please let me know if you have any alternate solutions.

There is no solution in law for such misconduct as the amount is not deposited to any fund which can be transferred, though ask your HR team to get in touch with Dy Director of ESI at Regional office or SRO, he is the only person who can put a tab on "help" button. they always co-ordinate in "genuine cases"
it may need couple of visits and submission of certain documents to establish the fact.
