Apprenticeship under the Apprentices Act,1961 and the training under the National Employability Enhancement Mission (NEEM) are basically on the job training programmes on contract basis for a fixed period in any designated trade with no statutory guarantee of appointment after completion of the training.
Yet another type of apprenticeship is in vogue under the Certified Standing Orders of the establishments. In any such case, they are learners and not workers and therefore can not be required to work overtime or during night shifts. They are exempted from the provision of the EPF Act,1952 and the PG Act,1972. But the EC Act,1923 and the ESIC Act,1948 apply to them.
FTC Employment has statutory recognition by virtue of the amendment carried out to the Industrial Employment ( Standing Orders ) Central Rules,1946 in 2018. The FTC employees are entitled to all the statutory benefits of employment on par with permanent employees including proportionate terminal benefits.
