You can not have an HR policy without considering the provisions of the law. If you are permitted to make your own HR policy and say that workers cannot demand PF, ESI, Gratuity, leave with pay, bonus etc then why should we have a law common to all establishments in India? Therefore, if not there in the HR Policy, bring it to HR Policy and provide it to employees.
