Respected Seniors and my dear colleagues

I would like to seek your help regarding a serious issue in our organisation .An employee of our company is absconding since the 16th of Nov,he was a good performer and based on his commitment we have taken up a project.He is a senior employee and hence based on his caliber we have taken up a rather complicated project which if now we are going to handover to some junior staff then he will minimum need 1month training.Due to his irresponsible behavior the company has faced monetary loss as he has also left his current project half done

We have sent a show cause letter to his mail id and also sent the same letter to his permanent address .We are aware of the company where he has joined in

The management is furious about this and wants to take legal action .Can you please tell me what legal actions we can take on him ?



The management also wants to publish his photo on the newspaper with a note that he is absconding from the company .Can we do that ?

Please help me on this



I expect your prompt replies on the same as the matter is very urgent

You have not clarified whether he is a permanent employee.Assuming he is one you can frame a charge sheet and conduct an enquiry.In this you can frame one charge of causing pecuniary loss .An enquiry officer has to be appointed and the Enquiry conducted. Publication of photo is serious affair.First you will have to serve notice in the Domestic enquiry on his last known adddress and on failure alone publication can be resorted to.
Only in Jobs involving the Absconding Employee representing the Company like Regional/Sales /Marketing/Branch Manager advertising can be resortedto. But again since it is a matter involving reputation you might have a claim from the person.
Please take specialist advice from a Pune based Legal Consultant.

Thank you so much for your inputs.The employee is a confirmed one inour company.Ours is a mid sized IT company .What happens if he does not reply to the show cause letter we have sent him .How to appoint an enquiry officer .What if he doesnt show up for the enquiry .Can we send him a legal notice to attend this enquiry .Please giv me some more inputs on this

spl.situation...let us know your appointment conditions and the repulsions apply when violations if done by either management or employee..
The company is like "time' ...it never stops for arrival or non arrival of someone...its like great river it continue to flow like waterfalls...takes and joins and leaves anything and goes...
So afterall an employee in a crucial place lost...sky will not fell down...standing earth not devided ..
Howmany employees come n go and retired or left...
So take it easy...thousānds of diamonds and gems like prodigies available on this earth..search
fill up the gap
renew the spirit of productive image side ofcompany.
Taking action on a cheated employee is not at all a big issue...your company advocate will do a lot...
Then
that fellow seeks severe medical reasons
and get over ...
why waste the company's precious productive time...
Go ahead..with right approach of easy going...Think less on revenge ideas..think better on right persons recruitment and on reserve persons on hand...
