One of my colleague worked for a company in Kolkata for 7 years and 2 months and the company now is not willing to pay her gratuity. He has been following up in the last month but the finance guys have been dragging things and finally saying that "our company is loss making company and we cannot pay the Gratuity amount". She wants to complain the same in the labour dept. to withdrawal her PF as well as Gratuity Amount. Can anyone please guide me the entire process to complain in labour dept to claim PF and gratuity. So that I can help her........

Pl fill up Form I under the West Bengal Gratuity Rules and send it to the organisation. If payment is not received within 30 days, the claimant employee can submit application within 90 days in Form N in triplicate to the Local Labour Officer duly supported by documents showing date of joining service, date of leaving service and the last pay drawn. You will get gratuity with interest. As regards PF, pl visit the EPFO site and you will get guidance on claiming PF amount.
