Dear all, Today i am confuse in central and state minimum wage. How to know which minimum wage is applicable for workers central or state minimum wage rate?

The definition of 'Appropriate Government' holds answer to your query. The Act defines
2 (b) "appropriate Government" means,--
(i) in relation to any scheduled employment carried on by or under the authority of the Central Government or a railway administration, or in relation to a mine, oilfield or major port, or any corporation established by a Central Act, the Central Government, and
(ii) in relation to any other scheduled employment, the State Government;
So as regards most industries except railways, mines, oilfields, major ports, corporations like LIC, it is the State Government.

To make you understand Mr. KK has given the description & provision under which it determines payment of minimum wages as per State or Central to be followed.
In a simple understanding, from whom(state or Central) you have obtained the registration or licence for engagement of labour. If the same has obtained from central you have to pay as per central rate of Minimum wages, other wise state rate of minimum wages.

1. In the Constitution of India there are 3 lists in the schedule, 1. Central List 2. State List 3. Concurrent List subjects falling there helps in deciding the appropriate Government.
2. There are judgments by various courts on the issue.
