Please clarify me that if the employees are on illegal strike then employer can give the no work no pay notice or not & to whom the copy of the same will have to submit. If you have a format of the same kindly share with me.
From India, Bhubaneswar
Dear Jagdish, How do you determine a strike by the employees to be illegal?
From India, Salem
Once the strike is declared illegal by Appropriate authority, the principle of no work no wage applies.
From India, Thane
Dear Jagdish,
You may not pay for the period of strike under No work No pay. But the strike either legal or illegal can not be decided by you. Whether the period of strike is legal or illegal has to be decided by labour department on receipt of complain from either party.
You intimate the matter to the labour department of your area for their action.

The locals of the area had closed our project demanding the compensation of their housed damaged during construction by previous organizations, of which our principle contractor had cleared that all the compensations had been paid/settled.
Now we as a new sub-contractors are facing the grunt of local populace strike possibly backed by one political party,
can we implement no work now pay, as we have no work activities is "die no" applicable
