Dear All, My company comes under Bombay Shop n Establishment. We are giving 30 Privilege leave every year. We are currently allowing people to take Privilege leaves 3 times in year provided leave is more than 3 days.
I want to know, is there any restriction on allowing employee to take it only 3 times in year or company can allow any number as per the requirement. Also is there any restriction on no of days as well like min 3 days.

Basically the conditions for availing leave are set by company and not by Shops Act.
So it is up to the company to decide whether allow employee to allow leave more than 3 times in a year, remove the min requirement of 3 days in one instance etc.

Yes, the Shops & Estb.Act does not lay down such restriction but he company can incorporate it in the leave policy to prevent it from being reduced to CL.

Dear colleague,
The Shops Act does not restrict availing leave 3 times or minimum 3 days of leave. The rules differ from company to company.
But I find sound logic in the practice of having such restrictions. It enables to regulate availing leave and ensures availlibility of man power for productive processes otherwise in free for all situation attendence of employees may become unpredictable and may disrupt smooth working.
