one of our employee had resigned the job & we stopped him coming to office and paid 2 months salary as notice period.
I have question if he is eligible for the statutory bonus, as there is no contribution from his service to the company during that 2 months.

Dear Munir, The only option to avoid payment of bonus will be eligibility criteria. If person had earned gross salary more than 21000/- then you may exclude payment of bonus for the same associate.
Hi Muniraju, I suggest you to calculate the bonus based on his attendance. The 2 Months salary amount is paid only for lieu of his/her notice period. .

First of all his eligibility for Bonus under the Act has to be checked.Assuming that he is eligible, in my view no bonus is payable on the notice period.Statutory bonus is payable on wages earned for having worked by attending duties. The notice pay is contractual obligation and cannot be equated with days worked.

has he is worked for least working days (180 to 240 working days) either the cutoff management decision ., but has to paid with bonus , it may later also , when we pay all the rest employees.
