Dear Sir/Madam,

I joined this organisation A in July 2014 until March 2017 wherein I was asked to submit a resignation as I was told that company has decided to transfer you to another organisation B in the same office premises with same reporting manager and other officials as earlier.

As I belong to not so good established family, I was under compulsion to resign on 8th April 2017 with my resignation letter backdated to 01st March 2017 as it was drafted by the company. In the organisation the notice period was of 1 month or salary thereof. On 17th April 2017 a office circular was emailed to me stating that I have been promoted to Asst. Manager in organisation B, but I still didn't had the appointment by then.

Somewhere during this time I got a better opportunity with other organisation C and I was in interview stage but just after one week around last week of April 2017 I was given an Appointment Letter by company B but it stated the notice period of 3 months or salary thereof and I submitted the copy of the same duly signed by me. Now when I resigned from org B and served 1 month notice the org B is not giving me relieving letter which is must to submit with org C. Org B is asking to pay 2 months salary as precondition to issue me a relieving letter. I am the only person earning in my whole family and I can't afford to pay this amount as I don't have such savings...

It was just coincidental that when I was interviewed by org C my notice was extended to 3 months by org B but I had not idea as I wasn't issued the Appointment letter by then and was in impression of 1 month notice as was with org A after all org A & B were sister concerns, whereas I told the org C of 1 notice period. Not only did I discuss the whole issue with my seniors before resigning but also I was told that if someone is going for better prospect we wouldn't withhold any documents. I have tried my level best but they are sticking to their guns for 2 month salary...

I am in a far need of expert advise as am really mentally disturbed and I cannot afford to lose my new job nor I have money to pay 2 month salary as I didn't get my last month salary as a compensation to 1 month notice out of 3 months.

The App Ltr of org B neither shows probation period nor confirmation and other crucial elements. And if they wanted me to be in other sister organisation why ask me to resign instead of transferring to org B? How could I be promoted on my first day of appointment?

Please advise if the below points are possible if the Appointment letters are signed by same person in two different ways in different capacity of org A & B and how I can have the things work out without paying? The org A & B are Private Limited organisation.

I have explained this case to several persons but they all get away with it terming it ridiculous but I have every single document to support the aforementioned but I finally came to know about this website and I have full faith that someone would really care to help me out.

Regards

Archer

Dear Archer,
1. You have to focus on key point of your query. You have created quite a complication.
2. Can you share the appointment letter of organization B or tell us specifically what was the notice period mentioned in the said letter?
3. Who is the signatory of the appointment letter of Company A & company B and what is their designation? One person can sign letters for two Companies if they are sister companies.
4. When was your notice period extended to 3 months & how was it communicated? What did you do when you got this information?
The information is required in plain & simple words without any colour of your opinion to advice appropriately.
