Dear Experts,
Want know that can Employer file a criminal case on a terminated employee after one year of termination?
One employee is terminated for bribery for giving jobs. His full and final settlement is not yet done. Even after company notice he is not refunding money to the employees from whom he has taken bribe for employment.
Please advice

Hi, As per my view, yes company as well as people from whom bribery amount is taken can file an criminal case. If you have proper / supportive documents for the same.

more facts needed to answer your query, however, as per available facts, company can initiate legal action against the terminated employee but you need to state the reason for such a long delay that too for a criminal action.

Company can not initiate any legal action against the erring employee for illegal graft as Company is not a "State" within the meaning of the law.
The delinquent employee has not stolen any company property he has committed the acts which may be termed as immoral and unethical for which company has already punished him by terminating the employee.
The Company should also terminate those employees who paid the graft, the above action of the company is one sided and it has taken an action which suits their convenience. Company is also not above board.
The employees who paid him the money can file cases for recovery, I doubt whether they will be able to win the case or not as they are also party to illegal activity.
