I am a contractual employee working for 8 years in a PSU.From January I took without pay leave for 2 months due to my compleacated pregnency,even my company is not covering my maternity benifit also as its covered by ESI.Anyways,my contract is ending on july mid.Now my employer dont want to renew my contract as I am not able to serve my company for another 6 months due to maternity leave.
In this situation what steps should i take to save my job.

I'm failed to understand, how come you are working on contractual employment for straight 8 years. If ESIC contribution is deducted from your salary that mean, you are getting regular pay and you must claim for permanency of a job if you are working without break. Also, to the extend the new amendment of Maternity Benefit is not only cover regular employees but also extend it's coverage towards contractual and consultants as well. If you were been shown on regular then you are entitled for Maternity Benefit and you will have job security.
Thus have word with your management and if they do not agree then you have an option to approach nearest labor office to get your issue resolved.


My contract get renewed after one day break every year. I am eligible to get maternity benifit from ESI only if my contract is renewed this year.

Dear Mrs Roy Amrita, as confirmed by you, you have been Employed on Contractual basis.Just check validity of your service,As per your latest Contractual Appointment Letter.Termination will be as mentioned therein.

Since. you have been covered under ESI, You have to approach ESIC for any benefit.You have stated that, recently you were under Leave for 2 Months for which you must have received payment form ESI.

Please log in to ESI IP Portal to know your eligibility under Maternity benefit? Your Contract expiring in July-2017 has nothing to do with your eligibility under ESI for Maternity Benefit.

As per your post from the past 8 years you have been contributing to ESI Continuously.Consequently, though you will not be in service, still you will be eligible for Maternity benefit subject to fulfilling conditions.Please check & revert instead of assuming.
