Finally Maternity Benefit Amendment Bill, 2016 has been assented by our honorable President and it becomes the Maternity Benefit Amendment Act, 2017.
However effective date is yet to be declared by Central Govt.

Until the effective date is not published we will follow the ESIC act for Maternity leave?

Sumtro You follow either ESI or MB Act ( as existed prior to amendment) till the amendment comes to effect.

Logically amendment is effective the day when President signs on it unless it is specifically mentioned.

Hi, Am at my 6th month, will be going on leave from jun..Am i eligible for 6 months leave or from when this law will come to effect.

could you please let me know , that , suppose if women is already on maternity leave before new amendment 2016 bill passed on 1st April 2017 and who have availed leave before 1st April 2017, is she eligible for new maternity rule 2017 , please elucidate

Effective date for all amendment to the maternity benefit Act is 1.4.2017,except crèche which is from 1.7 2017.
