Please some legal person help me out. I am in probabation period in a company.one month is completed and then they terminated me today and is not giving my salary of last month. What is the soltion for this problem.


First demand the salary in writing by way of sending a letter through registered with AD post. Wait for 7-10 days. If the company does not pay, thereafter you may approach legally.

Please elaborate your query what was the salary drawn, what was the reason for termination etc so that forum members can give their views accordingly, also as mentioned by above forum member give them time to release your salary atleast a weeks time to process, as per your statement your were terminated yesterday only and immediately you want to go legal since you have not received the cheque on the very same day.

Check the relevant clause in your spot letter relating to termination. During the probation, ordinarily, service is terminable without notice and without giving reasons by either party. If such clause exists in your spot letter, you can do nothing. But certainly you are entitled for salary up to the last day worked . Wait for a few days proceed to demand andolan if not given/refused , lodge a complaint with the Labour Authority.

You are entitled to wages for the work done by you for a month. Not clear under what ground the employer did not pay your due wages for the work done by you and under what clause of your contract of employment, if any. What was the employer reply when you demanded it ? However, you are at liberty to approach the appropriate authority under the appropriate labour lawa or other laws of the land , as may be applicable to you subject to condition that it may likely to be long battle costing your time and money and so whether it will worth taking this recourse. for you. You have to decide you action based on the amount of wages for a month involved. Thanks,,
