Usually Basic pay is A minimum wage...add every 6months V.D.A.(VARIABLE DEARNESS ALLOWANCE) TO BASIC PAY IN G.O.CIRCULATED BY STATE GOVT. FOR ALL PRIVATE EMPLOYEES..
SUPPOSE U WANT TO PAY M.W TO A CLERK RS 15000..P.M.AS PER LABOUR LAWS EXISTING.
TAKE RS.15000 AS BASIC PAY...AND ADD ANYTHING MORE TO IT...
BUT NEVER BREAK 15000 TO 10000. AND 5000 LIKE THIS
BASIC PAYRS 10000+ VDA. RS5000
=15000.
Y BECAUSE U HAVE NO RIGHT TO BREAK THE M.W FIXED TO CERTAIN EMPLOYEE ASBASIC PAY BY THE STATE. LABOUR DEPARTMENT..
U SHOULD REALISE THAT BASIC PAY IS FIXED BY GOVT.AS A MINIMUM WAGE .
ONE HAS NO RIGHT TO DEVIDE OR BREAKUP THE BASIC PAY TO DIFFERENT NAMES LIKE HRA TTA ETC
I WONDER ALWAYS I FOUND IN MANY SMALL AND GREAT REPUTED FIRMS WANT TO EAT AWAY THE WORKERS MONITORYo BENEFITS . WORKING OR LEAVING BY RESIGNIG ..ILL HEALTH MEDICAL LEAVED ONES.WHO ARE INNOCENT OF LABOUR LAWS..

The State Government is empowered to fix the minimum wages for scheduled employments under section 3 of the Minimum Wages Act. The house rent component without any cap is treated as wage as defined in section2(h) of the Minimum wages Act. Certain State Government's has further restricted the percentage of HRA in minimum wages.
Accordingly, you can split your minimum wages into BASIC and HRA in consultation of applicable norms of your State.

Minimum wages means Basic + vda/special allowances as revised by appropriate government(central or state). I shall be splitted by any means.
Further, for any company while deciding salary structure of its employees to ensure that their basic salary is not less than the minimum wages (basic+vda/spl allwnce) applicaple to that industry's scheduled employment as per mw act.
Moreover, for the purpose of PF contribution, please refer EPFO circular No coord/4(6)2003/clarification/vol II/7394 dt 23 may 2011. Copy attached

The circular has been withdraw by PF office. It was withdrawn after court passed strictures against the department.
