I joined a company on 23rd Feb2016 but I got the termination from my company on misbehaviour & in contact with person who provides business after taking Rs.15000 to 20000 against sale.
Which is totally wrong & this is the feedback of My ZM to the seniors on which this letter was issued, who knew about this.
The letter was issued on 24th May but i was on tour o 2 days & came back to office in 26th & this letter was handed over to me by BM & asked me hand over all the assets ov the company like laptop & mobile & other things. Also i was told to accept this termination ir resign from the post so that you can have your FNF from thr company after 45 days. I was not in a mind to think anything about & i was forced to write the resignation letter, that i did for the amount pending with the company.
Now after seeing various post on this site i came to know that if I am not wrong then why should be thrratened.
Plz help me if i can do something as i was on probation period & i had not received any show cause notice aginst illegal contacts with outsiders.
They do not have any proof againdt it.

What did write in your resignation letter?
This sentence gives an impression that you had illegal contacts but are only worried about no show cause notice etc?
What is the truth-proof or no proof with company.
Sometimes proof comes up.
Clearly tell whether you were involved in taking cash?
If so our guidance will be different.
If allegation is false,members will guide you correctly.

I was in contact with the person but had not done any business with him, the reason being in contact with him was the mobile sim card that was handed over to me, Was used by ex employee ofthe company.
i got a call for the meeting & had discussion on this. but i totally refused to him about this type of business in our company. After thay i had shared this incident with my BM. after that that person again called me after some days but the call was picked by my ZM as i left my mobile on my table. Now ZM thinks that i m doing such types of business with him & i had arguement with him on this issue, which he presented negatively to the management.

""They do not have any proof againdt it."" this means i have not done any business with him, as our system is very clear we charge the full fees from the candidates & as per legal liasioning our company offers gifts amount to them directly. and as a matter of fact my salary is not much that i can give the amount to him from my pocket.
now plz suggest

It is matter of trying to convince your management that you don't deal with such persons.
Probably your call records will help.
There is no workable legal way out of such human misunderstanding problems.
Suggest to try and convince and also look for change of job.
If they act on mere suspicion to extent of termination,then it is difficult to survive in such companies.

Termination for any kind of misconducts must be done following the legal procedure of issuance of charge sheet and holding a domestic enquiry. If the company does not follow it, the termination becomes bad in law. Obtaining resignation letter from employee using coercion is also illegal and such resignation amounts to illegal termination, if coercion is proved. For these kind of problems, solution is reinstatement and back wages. However since you have not worked for 240 days in the last year (date of appointment is Feb 2016) and also on probation, your case does not have solid grounds to stand on to.

Thanks all for your feedback but as per my appointment letter, for misbehaviour or for any such types of activities, i must receive a show cause notice or warning letter as the management also knows that such illegality cannot be done on ground level.
also I was handed over the termination letter after 2 days as i was OOS. Do i have a right to claim or can I sue a case against this as the act was not proved nor they tried too, just on the feedback they did this.
kindly suggest.

Boss at the end of the day, you have voluntarily resigned so standpoint in very week, yes your could only be strong when they have issued you a dismissal letter which no one does, since it has so many legal consequences
