i am brinda working as an HR Executive in engineering company. i would like to know about leave rules and leave policy. till date we didnt have any bifarcitation in leaves i.e., in a year an employee is eligible for 30 days i.e. 2.5 days leave per month.
but now our management want to introduce the CL,PL and SL in the leave policy. i would like to know according to law how we can frame an leave policy and circulate the same to employees.
i would appreciate if anybody helps me in this regard

Hi Brinda,
Their is lot of stuff available in this forum. If you put the Leave rules OR leave policy in the search column you will get the same.
But still very shortly i will give you the answer -
In the Factory Act the providion and rule for the PL is given is -
For Adults - For every 20 working days 01 day PL to be given. So if you consider 365 days in a year and deduct 52 weekly off and normally companies are giving 10 paid holidays so PL on the above will be-
365-52-10 = 303 days are the actual days of working.
So 303/20 = 15.15 days . so you can give 15 days PL as per above calculation.
If your company has already given total 30 days leave and if they want to stick on the same then you can bifurcate the leave as follows -
CL- 07 days
SL - 08 days
and PL - 15 days
For the above you need to frame the leave policy and leave rules.

Minimum 27 leaves are there as per law, but if ur ogganization is giving 30. it is good, it seems ur organization is employee oriented which is very good.
According to amit PL= 15 is ok.
CL= 6 and SL=6.
This is minimum requirement, above this you can add n number of leaves and that is optional.
So go ahead and use amit,so concept as per 30.

The Leave is from Factories act or other Acts like S/E or Motor Transport or mines Act.
Normally an employee is eligible for leave after completionn of one year continuos service .
for eligibility he has to work 240 days in a year
Now you can calculate one day leave for every 20 days of work. For Sick leave those who are under ESIC they will get the same and out of ESI
15 days per year accumulation 1/2 .
For CL it depends upon the Company may be 5 to 7 days in year.
PL is Previlage Leave . CL is Casual Leave SL is Sick Leave.

If nothing has been provided in your standing orders for the same then you can keep CL & SL around 5-7 days each or even more. But if you do this then you will also have to make necessary changes in your standing orders.
