Hi, One of the ask to go Employee Of My Company is Holding The Company's Assets (Laptop, data card). He has not returned the Assets , neither he has furnished any proper resignation to us. He went on long leave and was not reporting , so we asked him to part with company. He agreed for that verbally , but he has not returned our company laptop. He also took a small hand loan which he has not returned. We have nothing to adjust from his full and final settlement. All efforts through personal calls have failed. I went through the previous threads on this topic but could not get a proper format of a cautionary notice to be given to him for returning asset.My IT Dept failed to take any undertaking from employee before issuing the asset to him. We just have the details of asset given to this employee.
My sincere request is to please help me with an appropriate letter to be issued to such an employee to return the company assets he is holding.

Do you think that he is going to bother about any letter from your company??
Has the employee signed for the assets taken?
Any witnesses to fact of issue of laptop??
Any CCTV footage of employee with laptop of company?
Ring him and inform him that police complaint is being lodged for non return of advance and company assets.
Or send him a letter by speed post informing him as above.
If he fails file a complaint with civil police.

I am partially agreed with Nathraosir. You should have at least acknowledgement of assets handed over to employee.

Nevertheless You can send one Registered Post Letter (through Postal Department only & through courier) to employee stating that

You are inducted in Company on dated ------.During your tenure with Company you had allotted ------ make Laptop bearing Sr. No. ----------- Battery No.---------- & CT No.------- on dated ----------- as well as ----------- company’s data card for Company usage. It was clearly mentioned in our letter no----- dated ------- that these are the Company’s properties and you should take utmost care in it’s’ utilization. Further it was also mentioned that you should have to hand over all Company’s property while separation.

We had repeatedly requested you through phone calls to hand over the Company’s properties. Till date you have not deposited Company’s property. This is the last reminder to you to deposit Company’s properties within ---- days on receipt of this letter otherwise Company will initiate legal action against you for which you will be solely liable.

After posting above letter through post and after receiving acknowledgement receipt from post, you should wait for 07 days. If no response from employee or if employee discarded your letter even after acknowledging, then you may publish Caution Notice for public in general in local news paper. Pl note that the one notice should be publish in one local news paper having vide circulation in vernacular language and another in another news paper in English with photograph of concerned employee.

This is to inform public in general that Mr.--------------- aged--- residing at----------- was serving with us from-------- to ------------- as (designation). From dated -------- he is not attending his duties.

We hereby caution public in general not to undertake/deal/transact with Mr.--------- and if anybody undertakes/deals/transacts, the Company will not liable any way.

It is really embarrassing and shocking that company did not get any asset issue acknowledgement from the employee. This could be major NC on HR's or for that matter on IT's part as well. Because HR has to get it signed and then pass it to IT for physical handover. All the three parties sign it and eventually it goes in the respective employee's record.This is 3-4 step process which cannot be missed, how on earth did this happen. Atleast, is there any mention of this point in his appointment letter, pertaining to work station, internet usage and company laptop??

Secondly was there a proper background check done before having this employee on board? Are you maintain records of this employee? like copies of his PAN card , Adhaar card, driving license, passport? anything?

How long has this employee been associated with your company? what was the amount of loan or what was the basis on which company went ahead with the decision of approving him any loan?

I think whatever the other two seniors have suggested, that's the best could be suggested to you.

Yes , I agree there is a lapse in getting acknowledgement from employee while issuing Laptop. This is an eye opener for us. I recently joined this organization and trying to make all the process in place.
The employee was with us for almost 8 months. He was not confirmed and had some financial exigencies at home. So on humitarian ground we gave him the loan of INR 20K , going against the policy of giving loans to only confirmed employees. Due to his personal problems , he discontinued coming to office and now holding our company asset.
I am really thankful to Mr.A Prakash for his guidance and the draft he shared. This is exactly what i was looking at. Thank you so much.

Hence forth I will mention the asset related point in appointment letter and take an undertaking from all the existing and new employee who joins w.r.t asset handover.
