Hi, My query is about withdrawing my PF amount for the last company I have worked for. It was about 3 years and 7 months. I have not resigned the company but absconded due to my illness. Its been 3 months now and my previous company asking me to give them 2 months salary as I have not served the notice period. Please suggest me how do I claim the PF amount in this situation without consulting my previous employer. Currently I am not working and I badly need some cash to start a business.

You can ask your company for your PF UAN number if you join other company they directly claim for pf transfer. If you want to withdraw pf u have to take PF form from pf office and your this company will sign and stamp on this aft that you can submit to PF office. Any co. can not stop your PF amount withdrawal.

i want to ask with Mr. SUM_786, pl. read the query clearly person don't want to go with the concern employer for withdrawal of EPF . so how it possible to withdrawal the same amount from the dept without the signature of authorised signatory. second i want to ask why any company can't hold the pf of employee?

Hello Sir,
You can refer labour law no one can stop employees to withdrawal his pf amount. I know sir he mentioned he dont want to concern but if he want to withdraw pf in that case it's require. Without it not possible to submit pf form to pf office also i mention other way is transfer pf amount to current company. Employees have right to ask employer about his pf.

Whether you have absconded or resigned, the company cannot withhold your PF amount and as per law, the PF amount is also cannot be attached by any court of Law. Therefore, if your PF is unexempted., i.e. if it is maintained at any RPFC, fill in form No. 19 and Form No. 10-c., get your signature attested by the Bank Manager where you hold an account and send the form directly to RPFC with a covering letter. Your PF has to be settled by them. Company cannot withhold it under any pretext.
