One of our employees has died in a road accident. He joined our Company 5 months ago. We have deposited PF including EDLI contribution for 5 months. We have submitted the claim Form 5IF with EPFO Gurgaon. EPFO Gurgaon have informally rejected the claim and returned the documents indicating verbally that the contribution in less than 12 months so the claim cannot be entertained. May kindly give considered advise in the matter.

In EDLI scheme there is no such clause that minimum 12 months' service is required to receive EDLI. See a part of section 22 as " during preceding twelve months or during the period of his membership, whichever is less". This clearly states that EDLI is eligible for those having a service of below 12 months.
Kindly write to the Information Officer, EPFO Gurgaon under RTI Act regarding minimum service required for claim EDLI mentioning the above details.
