Hello sir,
this is pramod kumar worked in dr batras from last 5 and half year.recently i have left the organisation on 07/08/2015. now issue is that when i call HR regarding confirming my FNF cheque amount they told me around 8600/- but they calculate salary from 20june -20july and providing salary on 1st of next month NOW I HAVE RESIGNED ON 7AUG2015 but they are calculating salary from 1st of aug to 7th of aug they are not calculating FNF amount from 21 july to 7th of aug and also they are delaying in gratuity amount they told me for grauity amount wait for 2 monthp as they havent send any doc in lic office cheque will come from Lic office please help me what should i do now almost its going to be a one month still i havent received my FNF correct amount . please help sir

Hi Pramod what your company said is true. As per Section - 4(A) of Payment of gratuity company has to tie up with LIC agencies for gratuity amount. But usually it takes lessthan 1 month only but any way pls contact HR of your previous company once about your FNF

Whether the LIC pays or not it is the employer's liability to pay gratuity within thirty days after resignation.But ensure that company is covered by POG Act and you have more than five years continuous service with this employer.
If you do not get gratuity ,file a claim petition before the controlling authority under the Gratuity Act.

Mr Praveen Please check whether Sec 4 A of Payment of Gratuity has been enforced or not? To my knowledge it is not.
