If an employee who is on probation period of 6 months & working since only 4 months resigns & there is no clause in the offer letter for Notice period, then is any notice period required to be served by the employee at Manager position ? Also if he gives only 3 days notice period then what should be the maximum time period in which the company is required to settle F & F with all the dues paid to that employee (manager) ?

Dear Jatin, As you told there is no clause stating to serve notice period during the probation period,then its not applicable. as F & F settlement it will be done by companies standerds.

As you mentioned there is no Notice Period Clause, Technically he can leave without notice period but, Being a manager it is his moral responsibility to give minimum 15 days Notice Period.
F & F settlement is as per company HR Policy.
But F&F Settlement must be done within 45 days of Proper Relieving of an Employee is Appreciable.

Dear Jati,
You said that there is no clause of notice period during probationary. period is specified in the appointment letter. In such case the question of notice period minimum or maximum does not arise. Since he has given 3 days notice period, you accept his resignation and relieve him from the post after clearance from all the departments and settle his account. Since the Company door is always entry and exit but not one way.
