Due to some issue with the management i resign from the company and serv......ing the notice period and due to mentally harassed i couldnt do my daily basis r....eports and.... couldnt assign to someone one week is left so please can company deny to hold my relieving letter and experience letter...if yes then help me what should i do in my lastsweek to get relieving letter and ezperience letter

You have not stated which industry you are in and what your position is in the company.

The reaction of companies differs and there is no straight answer to give you. In most companies the fact that you have served notice period is enough for them to give you the reliving letter. However, if you have not done any work in the notice period, for whatever excuse you give, there are chances that the company will refuse to do it claiming that you have not done any work or completed a handover.

You can take legal recourse, but that is a long drawn process and in any case, they are going to give negatives in any background verification.

What you can do in the remaining week again depends on a variety of factors that we can't as ascertain since we haven't been in your company and don't know the attitude of the HR or managers.

Therefore, the best option for you would be to approach your manager and ask him what you need to do in the remaining week to complete the pending work that was a sign and how to complete your hand over properly. You should also speak to the HR and see what needs to be done the remaining period to get relieved properly

Thanks sir actually i m working in genpact as process associate....there were some misunderstanding in between me and my manager....and i react very unprofessionally and resign instead of taking smart decision professionally....i said wrong words about mgt while at the time of giving resignation because i dont have any trust on mgt they were trying to stop me to give resignation but i wanted to move from there so the problem arised.....now they are playing tricks with me and was unaware about the company law....now i want to go from the company with my documents but i have only one week in which i cannot upskill the assigned person and assign all the reports.....so want to know whether its better idea to increase my notice period give all company assets or it would create more trouble for me.....and they dont increase my notice period so what should i do to get all docs...

Actually story is i was expecting for the promotion and result was failed then i informed my manager that i will try to switch to the other company for some hike in salary but my manager wants me to stay here....after fews days sent mail to the hr manager for rsignation but my manager convinced me and ready to give internal transfer but she playing game with whenever i went for the interview i rejected...and at the same time she was trying to know about contacts with whom speak on phone......so she checked my phone without my permission because phone is submitted outside the floor area.....so instead of raising an issue i resigned very unprofessionally....they tried to convince me so that i dont resign but rsigned ....now they playing tricks with me and mentally harassed me....and i am sure will not issue my relieving letter experience letter because i couldnt assign my daily reports and upskill someone now i have only one week...so what can i do to get my all docs because i dont know whether will increase my notice period or taking me back...its on my mgt may be they will take me negative....so pls assist.

In my point of view, you should not discuss these things with your all identity exposed. becuase your HR team may part of this Social Network.... It may create more trouble instead of solution... My Suggestion that, Discuss with your Manager as well as HR team for smooth relive and they may get a apology letter in written for the harsh beharviour done by you. It will not harm you like you will go again against them.
Discussion and apology only may have solution in your case as you did mistake and management always have all their policies which Employee may not understand while the time of Appointment. Also there will be a clear statment in your appointment letter that you have to agree the Management Policies and Management will be final decision authority.
So, Pls act smart till the time of relieve.

You mentioned that due to issue with management you resigned,this indicates management is not happy therefore things will not be so easy now.However I can suggest that get departed amicably at the last moment and get your work done with politeness.When u are at your weakest be humble and have patience.

Actually my manager didnt say anything wrong to me they were polite but i treated bad because i was unaware about the corporate laws and this was my first experience but....so pls assist.
