Please help me when shall i leave the job?
my baby due date is 26th june. from 2.5 years i am working in same company but i didnt used ESI benefit. But now i want to take maternity leave from may 1st week. I checked with ESI doctor they told me to work upto delivery. after delivery come here we will give 84 days salary.
my Question is if i take leave from may will i get my salary from ESIC? or else if i resign the job in April month what is my last date to use ESI Benifit.

1. Dear member, it is wrong to mention that ESI Doctor will "give 84 days salary". ESI dispensary or doctor examine the insured woman and issue her medical certificate(s) on sickness and in your case regarding maternity benefit. The said certificate(s) are to be deposited with appropriate Branch Office of ESIC to which you are attached or in case of online procedure (if in operation), the same is sent to Branch Office automatically. Therefore, it will be more better if you visit the Branch Office of ESIC to which you are attached. The "salary" to which you have mentioned is not proper term so far as ESI Act and rules/regulations are concerned. It is called "maternity benefit". Further, it is for the appropriate Branch Office to certify about your eligibility for the said maternity benefit.

There are certain conditions to be fulfilled in order to obtain the maternity benefit under said Act and obtaining of medical certificates from ESI dispensary and to submit the same to Branch Office of ESIC alongwith your claim is one of them. Therefore, it will be better if you contact Branch Office Manager of the area to which you are attached. After consulting the records, only the Branch Office is in a position to confirm whether you fulfil all the conditions for payment of above benefit.
3. In my opinion, you can get the maternity benefit for the eligible period as may be certified by the concerned ESI doctor/dispensary subject to maximum as laid down under said Act. There appears to be no requirement of leaving the job as per provisions of said Act.

Sir, you will be entitled for medical benefit (medical facilities) from ESIC upto close of current benefit period provided you were entitled for such benefits due to minimum contribution as required under ESI Act and rules/regulations framed thereunder. The current Benefit Period has started from 1st July, 2016 and will close as on 31st December, 2016. However, eligibility will depend on records of your contribution as may be available with the ESIC Branch Office to which you are attached. Therefore, it is better to contact the concerned office and ascertain the position accordingly.
