Hi, I am working in IT company along employee strength of 40 people, But there is no PF deduction. So Please guide me why? Is PF mandatory for company or optional .Because employees are exceeding 20.

Compliance of EPF provisions is mandatory and cannot be avoided once the establishment is covered under it and the salary of employee is not excessive than the limit prescribed. Later even if he crosses that limit, yet he continues to be governed by it. In order to get implemented the EPF provisions, get asked from someone to avoid unnecessary wrath of employer, under RTI Act the EPF code number and the number of employees covered in respect your organization. Ask whether the inspector has investigated the number of employees shown in register maintained by employer under Employees Shops and Establishment Act and whether all eligible employees are covered under EPF Act.

For any company, employees strength is crossed more than 20, It should register for EPF. they have made it very easier to register the companies through online. They made procedures easily. Better is to register by our approach.
If they inspect, it will be a difficult scenario. They will demand to contribute pf for left employees and demand penal damages for not following EPF act.

Question is not of online facility availability but of mental set up. Prior to it also, a formal application was to be submitted once the establishment was covered under the Act. Who knows on online how many employees details are given. Why an eligible employee should be left out. When law is there no one can show about ignorance of its provisions.When certain employees were required to be given membership since they were covered, why they should suffer. There are decisions where employer does not cover an eligible employee, he is required to give back arrears of contribution.

Hi... it appears that your employer , tries to escape the statutory liability and deprive the rights of employees as per the provisions of EPF and Misc Act 1952.
