Dear Seniors, In our org., one employee is found guilty of stealing some merchandise & is terminated, will he be able to get PF & Gratuity benefits?

In single line query the members cannot give appropriate view until it is in detail. The employee can claim PF, with regards to Gratuity it can be forfeited only on termination of an employee for moral turpitude or riotous or disorderly behavior. Wholly or partially for wilfully causing loss, destruction of property etc. Apart from that if he has not completed his qualifying term.

Stealing Merchandise amounts to moral turpitude, since the value of merchandise is not known, and the employer has not initiated legality as per the query. It would be assumption to give views before knowing the facts. Hence written the clause of forfeiting gratuity, please guide us if it is wrong on my part.
