Dear Cristudas,

PF and ESI is applicable to construction contracting company.

As regards to PF:

If you have 20 and more employees including directly and indirectly employed for you, you are falling in the ambit of Act and liable to obtain PF code & comply the Act accordingly.

If you are executing contract work in PF covered establishment and you are employing even less than 20 employees or even employing one person in such PF covered establishment, you are liable to cover the employees employed in such PF covered establishment under the PF scheme by virtue of PF applicable to Principal.

As regards to ESI:

It seems you are from Ahmedabad. If your office including branch offices employing 10 and more employees, ESI Act is applicable to you.

You can exempt your construction site workers from coverage of ESI as per the circular by ESI HQ; Construction 4/99. However, your regular employees, technical staff, engineers etc. working at project site are coverable under the Scheme if their salary is less than 15K(Gross).

If your office / branch offices and construction site is situated in non implemented area, ESI is not applicable.

As regards to other Labour Laws:

You are subjected to many other Labour Laws as listed in below given link. In the said link, some of the enactments are of State of Maharashtra. You may be having similar enactments in the State of Gujarat that you have to find out.
