Hi everyone ,pls help me with this situation that if salary 35k n emp...wants to contribute in esi so how much is the contri fron emp... n er side as per 15k or 35 k pls help?

ESI contribution is not covered for the salary Rs.15001/- and above. but if salary is Rs.15000 and below, we have to contribute 1.75% from Employee on gross salary.

It’s not a choice. If someone has a salary of 35000 per month, that employee can not be covered under ESIC

As per ESI Act, There is no chance to contribute ESI for salary is Rs.15001/- and above.

Dear member,
1. Social Security Schemes viz.ESI are not optional. Such schemes are compulsory because there is element of compulsory contributions and compulsory insurance.
2. At present, in social media i.e. newspapers etc. too much matter is being published against ESI & EPF. Even Govt. has drafted some bill to do away with such schemes in medium scale/small units/factories. Under such situation, may I know as to why you want to become a member of ESI Scheme and contribute though the statutory limit of such coverage is only Rs.15000/- per month.

Please clarify what is illegal under the act.
To the best of my knowledge, it is illegal to try getting ESIC benefits for an employee whose gross salary is above 15000 per month.

Under the Employees' State Insurance Act, coverable employee means one who has been drawing salary/wages up to Rs. 15,000.00 per month. Only those employees are entitiled for coverage and getting subsquent benefits under the Act.
If any body drawing salary/wages over and above the limit for coverable employee, is covered under the scheme, it will be illegal as the said employee is not an employee undere the definition "Employee" under the act and as such even if he is covered, will not be able as alos legally eligible to drawn any benefits of the scheme nd ESIC corporation will not entertain any claim from such non-coverable employee.
