I am working with a MNC having its head office at United States, We have a uniform leave policy for US, New Zeeland offices. I have given a task to develop a Leave Policy for India office situated in Gurgaon Haryana.
Is it possible that we can apply the same policy for leaves as it is in US and New Zeeland or We have a develop a Leave Policy as per Indian Rules/ Punjab & Haryana Shop and Establishments Act.

If your company is registered under Punjab Shops & Establishment Act, then you have to follow the rules of the State Act.

Dear Ajay ji, As long as you are providing better provisions under your any policy than that of the statute you are subjected to, there is no issue.

Dear Mr. Ajay ,
Better to follow the concerned State Shops & Establishment Act/Rules where your office is located regarding leaves and paid holidays.
However, if your leave policy incorporate all statutory leaves/paid holidays provisions as prescribed under the concerned State Shops & Establishment Act/Rules where your office is located , then you must give in writing informing the concerned Govt. Labour authorities about it for hassle free compliance.

Please also do let me know, if we have Total 30 Leaves in a year. Do we have to put them under the heads of EL, CL and Sick Leaves or we can only say in our Policy that there is 30 Leaves in a year.

If your state Shops & Establishment Act states or specifies CL/SL/EL differently then you have to follow accordingly or else you can draft the policy as per the need. Last but not the least it is advisable to put CL/SL/EL different in the policy for smooth functioning

if as per US leave policy, is greater than indian leave policy you can go ahead and if US leave policy less than Indian rule then please maintain it as per indian state rules.
