I had joined a company a month and half back, while joining i was promised couple of things , but after joining (with in couple of days) i felt that all the promises mentioned are not going to be fulfilled, so i told them i would leave the company immediately, but the management remained me of my employment terms , so i had decided to serve my notice period. At the end of the notice period the management requested me to extend it by one more week which i had done so that i would have a smooth exit (i.e no issues in my salary payout). Suddenly they are saying that couple of components in the salary are quarterly payment, which would not be given to me and i reminded them that there is nothing mentioned in the offer letter regarding the quarterly payment and they are now saying that i was not in the payrolls , i told that when i have served the complete notice as per the company policy and there is no document shared with me regarding the change in my employment or salary terms, how can you say that am not in the payrolls. There is no response from the HR , even the vice president who is in the loop is not replying . Interestingly they are saying that PF contribution (Employer) is also quarterly payment.

The amount which am loosing is around 18k. Can somebody please help me.

Answering your query point by point : -
>> Resignation or Continuing service with them is your decision based on your observation.
>> Accepting the employer's request to serve notice and extended notice is your loyalty.
>> Many a components of compensation are periodic and will be paid based on your service which might be not mentioned in the appointment letter but would be as per Company policy.
>> Your appointment Letter can clear the matter that on whose rolls your are either on Company roll or third party pay rolls. That can not be changed without noticing the employee.
You would have all the proof in your hand to sue them in the respective court. But my opinion is not to fight for such a small amount which would not be good for your future itself.

Thanks a lot for the reply. I completely agree with your point.

Regarding #3, I agree with point that Its with the company to decide the variable and fixed components . How can an employee know if its not mentioned in the offer letter regarding the variable components. If its mentioned in the offer letter , then if we like it then we can accept else reject it.

I feel that this is unethical hiding the details of the payout. Moreover when i asked him regarding the Terms and Conditions doc he simply said its Confidential document which cannot be shared.

Yes as you said its not a big amount, if the company was downsizing then we can leave this amt and if the company wants to take away that amount unethically or unprofessionally then i think somebody should be able to help us.

I need small information from you regarding this statement "....which would not be good for your future itself", what can he do to my future.

Can you please guide me as to whom i should reach out to who can help me. This is not about the amount. The Co Founder threatened me with my future if i did not stay back.

2. Relieving Letter.

3. Resignation Letter.

4. Email conversations.

Dear Srinath,
I mean to "....which would not be good for your future itself" is that every organisation are doing reference check and your new employer would definitely do this. If you will leave your current organisation in controversy, then your current employer will leave the negative feedback about you which could be harmful for your future.
If you want to sue them, please contact to a Labour/ Civil Advocate to file the case against them.

Dear Leeladhar,
There is no standard of salary structure. Its completely depend on the company policy while minimum wages should be in consideration. As per PF rule Basic wages should not be less than the decelared minimum wages.
