Dear All,
I am new to HR. Working in a small concern located at Chennai with 30 Employees.
Please guide me regarding pay slip. whether ESI is compulsory for all employees ?

Yes ESI is compulsory for any unit small or big irrespectively, if the employee count is more than 20. Please get your ESI registration immediately

In Chennai, threshold limit for coverage under ESIS is 10 employees.
Dear Gopinath ji,
You are having 30 employees. ESI Act is applicable to you if you are in implemented area.
Employees those who are drawing gross salary upto 15000/- per month are coverable under under the ESI Scheme.

1. The requirement of coverage in respect of "factories"and certain "establishments" is separate. The first category of units are coverable under section 1(3) and second category under section 1(5) of said Act.
2. Threshold limit for coverage in respect of "factory" as defined in ESI Act, 1948 in all implemented areas is 10 or more persons.
3. In respect of certain establishments majority of States including Tamil Nadu have also reduced the limit of coverage to 10 or more persons i.e. at par with coverage of "factory". However, very few States like Maharashtra have still to reduce the threshold coverage in respect of said establishments to 10.
4. The member who initiated this thread has not clarified whether the unit in which he is working is "factory" or "establishment" and has also not clarified whether the same is covered under said Act or not.

ESIC applicable on 10 or more employee if you are using / manufacturing with any type of power like gen set , elect.
if you are not useing any power than ESIc applicable 20 and more employees as per ESIC Act.

Dear Friends,

Generally I try to avoid poking my nose in the discussions going haywire. I am not a moderator or senior member of this forum and therefore it is not appropriate to do it. But this Sunday evening I can not control my self from writing as under.

I am very sorry to say that maximum discussions in this forum are haywire. Okay, this is an open forum and everyone has a right to express his views but it does not mean that any member can write any thing without confirming to his knowledge as to it is updated or not.

ESI amendments of 2010 and implementation of it by various State Governments till date etc. are well discussed in this forum by learned members in many threads but still some members talk about the out-dated law.

It is expected that if a learned member like Shri. Harsh Kumar Mehta who is a retired officer of ESI with legal background writes something, one should at-least have a halt for a moment before writing something contradictory.

This I am writing with a concern that the readers of such post may carry incorrect information with them. Therefore, it is expected that such haywire discussions should be concluded by Moderators and Senior members as to what is right and what is wrong. Then only the discussions will be complete and meaningful.

I regret for this post of mine but as I said earlier, it was beyond my control.
