my question is if company not paid subsistence allowances in suspension period or timely not paid to suspended employee then what step will follow. And how how suspended employee will get her allowances what is the procedure in westbengal .kolkata....
If his gross salary is 12000 then how much
will get in (suspension period total =45) day. Payroll generate period 7th every month . Suspension period start from 12th july 2014 to 24 august 2014.

I assume that the suspended person is 'workmen' under the Industrial Establishment ( SO ) Act 1946 or an 'employee 'under the West Bengal Payment of Subsistence Allowances Act 1969.
For the first 90 days of suspension you have to pay him 50% of wages (basic+all allowances as per terms of employment).For the next 90 days pay 75 % of wages.Act .
If sub: allowance is not paid the workmen can approach the state Govt or it's delegated authority. under the WB Act or labour court as per SO Act.
