Dear Seniors,
I have a query in respect of notice period Recovery from the employee. If the employee does not provide the complete notice period then whether the recovery should be on gross salary or on basic salary.
Is there any legal reference to this point?
Or is it completely at the discretion of the employer. Please help me in this.

Hi, Its complete depends on employer, but when you issued appointment letter what clause mentioned for notice period recovery, if not mentioned general recover amount is 1 month salary.

Fixing the Notice period is whole discretion employer, it is not mentioned in any law, subject to it should be realistic or mutually consent by both party.
Recovery of Notice period is against whole discretion employer, whether on basic or gross salary. but, same need to be specified in employment term & conditions (Appointment letter).
Its like as agreement between two parties.

it is simple to understand that if there is any agreement is made or any clause is clearly written on Appointment letter. Notice period will be paid accordingly. regards TEJPAL NEGI

Salary means the basic salary + other allowances getting in monthly salary. So recovery of notice period salary also will be the same, but not basic alone.

Notice period recovery or paying is as per agreed contract or appointment conditions. It is normally same for both employees and employers.
In my experience with various reputed Engg companies in India, the Notice Period payment is on Basic salary.

As per my opinion salary means Basic plus DA rest other are allowances. Normally notice period mentioned in appointment letter for one/two/three month salary in lieu of notice period.
