I am an Employee of AXXX Company,

I resigned forcibally from this company due to background checks many times times they tortured to produce documents of experience certificates. I produced whatever supporting documents I have with me.

The HR called for discussion on this issue and forced me to resign on the spot with mail stating that " I am resigning from AXXX company due to personal reasons. Now they are not giving relieving letter forcing me to return the bonus amount of 100000 which is given to me when I joined the AXXX company.

During my verifcation many times they called me and tortured me to produce the required documents and even I cried.

Please guide me what can I do ?.

final mail communication I had with them is " I am not able to return the required amount due to forcible resignation and torture. Please release my relieving letter and credit for 15 days of work salary to my account"

Please tell me what shall I do?

Dear Ganesh,
Kindly let us know the exact scenario? What do you mean by torture for documents? You also mentioned Back Ground Checks, but why would they call you for back ground verification?
Also nobody can sign an forcible resignation from an employee.
The company is right if they are asking back the joining bonus amount paid to you and if you have only worked for 15 days....
You need to give the exact details for anybody from this forum to give you any feedback.

The Exact scenario is as follows.

I joined this organization on Dec 30,2014.

They forced me to resign on 16th June 2014. They do background verification for two previous companies.

The previous documents are fine no problem but previous this company I was working on contract...due to improper payment issue I left that organization. I worked there for 1 and half year....they were paying salary by check ......sometimes no salary......In present company came to know this in background verification.....they called me to produce the correct documents. I gave apponitment letter, payslip and relieving letter....I tried my best to produce the required documents...but finally It was not possible to produce the documents.....So they called me 4 times...for discussion....they were behaved harshly and showted and even they made me to cry.....In the final meeting they forced me to resign. on the spot. She told me to write like I am resigning this company due to personal reasons.......I did it as guided by HR. Now I am aasking for relieving letter they are not giving....they are asking me to return 100000 bonus amount. I was engaged in project also.......during my tenure.

Please answer me how can I proceed with this.....they only forced me to resign and now they asking money.......is it rite?

Dear Ganesh,
This clearly shows that you had withheld the information about you being on contract rolls when you joined the company. Also the documents that were submitted by you would not be in tandem with the information that was given by you at the time of joining. As they have found errors and false information in your information, they are asking you to resign.
It is fair that they are asking for returning the Joining Bonus, as you have provided them with false information.
If one submits a false information in the forms with the companies and the the verification sends out a completely different information, any amount of crying will not hold true.

What ever information provide by u to company is true or false does not matter. if wrong information provide by u the can issue memo or terminate u. u can file a criminal complaint by consult with advocate with time limit to file a complaint. Talk with co. once again that u r going to file the criminal complaint and negociate the matter accordingly.

Dear Gharanpallu... Kindly refrain from giving wrong information or information for doing something which is unethical. If the information is wrongly provided, what will he do going to the court?
