D/s, Can any one suggest me what is the correct/legal method of fixing pay after promotion in PSUs. For example any non-executive employee get promotion in Executive cadre in his/her organization. His/her basic was in Non- Executive cadre was Rs.24000/ pm.and he is being selected for E-2 grade in the pay scale of Rs.20600- 40000/-. My question is what would be his basic after promotion and how this can be fixed. Kindly guide me what is correct method according to Law and in promotion what is protected? Basic payment or Gross Payment, kindly throw light on this?

Dear Alok,
You have shown that the old basic as Rs. 24000 and new scale as Rs. 20600 - 40000. But in both cases you did not furnish the increment rates. For pay fixation increment is required and hence furnish the same in both scales. Also kindly state that whether annual increment is due at the time of fixation.

Thanks AbbasJi for your prompt reply. Annual Increment Rate is 3%. Which is given in every April of the year. Hope this will help you. My question is that time of promotion from non-exe. to Exe. cadre basic can be reduced to compare with earlier basic.

Dear Alok,
Your basic will be protected. But in case of gross salary, if there are some benefits to non- Executives which is not applicable for Executives, there is chance to draw less salary than the previous.

Dear Abbas Ji, Thanks for your reply. It means basic can not be reduced in any case. Basic should be protected. Our organization has reduced the basic drastically and made a formula and stating Gross Salary is protected. Although Gross Salary is protected but as for as I know Basic can not be reduced (FR-C), as the increment which we get every year is our hard earn money it also suggest that how much experienced we are in the organization in terms of years working. Kindly throw light on this also. Thank You.
