Hello All Seniors,
I would like to bring one point here to discuss regarding notice period & reliving of an employee. I work with Pvt. Ltd company wherein 100 employees are working at present. One of our employee has resigned due to pursuing higher education, her notice period was 2 months and she had asked to get her relived after serving 45 days of notice. Management did not allow her to go early even she was ready to compensate salary in lieu of short notice period.
After waiting for 45 days and no change in management stand, she registered complaint in Police and yesterday 3 Policemen came to office. This put me (as I work here in HR ) under tremendous pressure & guilt about the Image of company and kind of Policies which we follow.
I would really request you to let me know, has management of any company play any role in relieving of employee? Who's responsibility of employees reliving & full & final settlement process? Why should HR take blame all the time? and what is the right of employee in such case?

Hi,
If in case, it is a flat organization, Management takes care of his relieving orders and make HR understand how to proceed with the process.
Is there a any misbehave had been recorded by that employee? If no, why dont she can use that buy out option and leave the organization ? what is Management intention ? This Should be considered.
HR should follow up with Management and explain the consequences , We are here to provide inputs to the Management and do our work genuinely without any disturbances.
