Dear Friends, Could you please guide me if there is any gazette notification for 2nd October Holiday? Kindly advise me so that I can refer to it to declare holiday on 2nd October. Regards, Sharmila

If you are a commercial establsihment covered by the Bombay Shops Act, the said Act itslef declares 2nd October as Holidaybeing Gandhi Jayanti. If you are bank, you need to see the notification of the State Government under Negotiable Instruments Act declaring 2nd October as holiday.As jasmine said, you can get a list of holidays decalred by Maharstra Stae on internet.

No Central legislation exists on the subject as they are the issues relating to State legislature. Almost all States have framed their own laws on the subject.All the States have made the provisions of the leaves including National holidays in their respective Shop & establishments Act and rules. Republic Day (January 26), Independence Day (August 15) and Gandhi Jayanti (October 2) are the three national holidays observed in India.Some of the states have declared May day as national holiday. Observance of these national holidays are mandatory for all the institutions, irrespective of under which law they are covered, or whether they are public or private organizations or MNCs. They all should necessarily remain closed.On the other hand, the festival holidays are decided based on the local festivals of that locality and are granted to the employees in accordance with the company policies.

Sh B.Saikumar has given you the correct position regarding 2nd October as Holiday being Gandhi Jayanti under Bombay Shops Act.

Some of the states have enacted separate legislation for administering national, festival holidays,casual & sick leaves. I have come across the following states, which have separate enactments:-

(i) Haryana (National & Festival holidays & Casual & Sick leave ) Act & Rules

(ii) Punjab (National & Festival holidays & Casual & Sick leave ) Act,1965 & Rules

(iii) The Odisha Industrial Establishment (National & Festival) Holidays Act, 1969 & Rules

Like wise there must be other states too.
