I have some query related to resignation in probation period. I have served 30 days notice in my company and after my resignation they dint replied as they told me Our boss is not here and he will resume after a month and just before 2 days on completion of my resignation he came and HR had put me a mail that as per offer letter you will have to serve 2 months notice period so you have to extend 1 month.
As written in my Offer Letter:
1. Within first 6 months we reserve a right to terminate you if your work founds unsatisfactory.
2. After 6 months 2 months of notice can be served either company or employee
3. Once employee is permanent notice of 3 months can be served from either side.
My Queries :
1. As per above mentioned terms I am confused how much notice period I should submit.?
2. Is it true an employee on probation period can leave within 3 days serving notice?

Dear Member,
This is not your fault that company boss is not present. Today, in technology world, company can convey message regarding your notice period through Mail, Phone etc.
If they are asking this silly type of excuse. than strictly asked them to relive.

i want to ask you pls read that terms written as per offer letter which i have mentioned in my 1st msg. according to you my notice period is 1month or 2 months?

If you was accepted offer letter mentioned above terms & conditions than you could serve notice period as per offer letter.
and it is also,
there are no such defined rules about probation period. Some organization have 3 months and than another 90 days of probation and some of are complete 6 month probation period mentioned offer letter.
I am sorry to say that quieting from organization during probation period is not looking good in any industries.

The part of the offer letter you quoted says the company can terminate without notice during first 6 months. It does not say how much notice you have to give. If there is no specific term, then you are also entitled to leave without notice as rule of equity provides that you have same notice as the employer.
The 2 month notice will apply if you have worked for more than 6 months.

Officially, you can do a lot of things
you can complain to the labour commissioners office
you can send a legal notice
you can file a complain in the labour court
In reality, you cant do anything.
This is the unfortunate part of Indian Legal System.
Every thing takes too much time and efforts, which disrupt your normal work in your next job.
So, speak to your new company, show them the appointment letter that that you dont have a notice period. Show that they are insisting on 2 months which is not possible and that you will come without relieving letter.
