i handed my immidite and irrevocable resignation 2 days prior to effectivity date.my manager received and signed my resignation letter but said that they would file an abandonment of work case against me.i didnt report for work anymore and in the later partbof the day, they sent me a notice to explain within 24 hours and notice to attend after two days about a case that i didnt know i was involved that they said they need to clarify with me as part of the investigation.i chose not to answer nor attend the proceedings.first question, will my resignation hold since my manager received and signed it?second question, would they have the right to still terminate me even if i have resigned already?will i be held liable for not attending the proceedings since i chose not to?technically when i received the Notice i am still employed as my effectivity would be the next day but since the next day i am resigned i chose not to attend or even answer the notice.this is my understanding of the situatio

One cannot terminate you , if your resignation had already been accepted. May I ask what prompted you to such an action ? We need to understand why an enquiry was raised rather than retention.

the reason behind my immidiate resignation is because of employment for another company..i have some stuff to finish also.i wasnt informed before my resignation that i am one of the staff that they are investigating upon for fraud.apparently there were some POS transactions under my password and transactions during my shift wherein customers card info was obtained to be used for transactions in other establishments they did not make.that's what the notice said.

when i handed my resignation,i gave two copies.she said that she wont approve it but she will receive it and affixed her signature.so technically, since she represents the management team of the company as she is my immidiate boss and branch manager, then my resignation will hold or is already accepted.

Dear Melziz,
Please speak to a lawyer at your earliest. If they are scamming you in fraudulent activities , you need to know your rights.
What are the probable charges that they can bring against you? How would you counter those charges ? What are your basis for pleading not guilty?
Please talk to your new employer on the documents that they would need. This case may not affect your employment, but you need to act really fast.
Resignation marks an end to the employment. When they had accepted the resignation, it cannot go beyond that. However, they bringing in charges against you might turn the case to a new direction.
Wish you all the best.

If I read the above correctly, the resignation was received not accepted.
The concerned manager signed the letter to acknowledge receipt of the same.
She has already communicated that it is not accepted and that short notice will not be accepted.
Further, this is a case of fraud on a POS system involving apparently fraudulent transaction involving a customers credit card. Resignation a day before start of investigation and refusing to attend enquiry on a flimsy ground looks very suspicious.
I would not be surprised if the company terminates him and files a criminal complain for fraud. It is very much likely to affect his new employment. The HR of the old company has no reason to keep quiet when the verification call takes place.
