I am working for company from last 6 years. I was hospitalized, & now under medical treatment, I am in need of leave for medical treatment, As my a/c SL are over but I have PL more than 90 days in a/c, I have applied for leave & request for PL to be adjust ag., But HR is saying in will be leave without pay. Pl advise when EL available in a/c how can co, denied to adjust PL , & put me under without pay? pl advise me if any law or any clause under labur law ,

Hi, First of all you please tell us your HR policy on leave matters. Prima facie your HR people are on wrong side. They should approved your PL against your absence. Regards

I have never come across where the SL can be accumulated or the SL is equivalent or more than 30 days, since you require a months leave, the HR should extend you the PL/EL. It seems that your HR is not in good terms with you, even on an Humanitarian ground one should adjust looking to your term of 6 year in the organisation. But again as few of the seniors advised you please go through the Leave Policy, you may get some lead or let the forum know the Leave Policy to advise you further.

Working in a private limited company, employees can avail only 8 PL & 14 EL and have no SL. This is our HR Policy. Can any company work against labour law. More than 20 employees are working. How to avail leave as per labour law as some of the employees have to visit their native town once in a year that is more than 2500 KM away from delhi and if that employee already availed PL & EL due to sickness or other reason, their visit to native place will come under Without Pay. Please advise.

I would like to say Why HR person is not understanding that any employee is first a human. so first think as humanity after being as HR. the leave which provide by the company to any employee is totally for employee so i don't think in this situation any Hr must think about the leave policy. just think if you will be in place of your employee then what u did ?
So never create any situation like this, so that employee feel hurt. if he is under the medical treatment for more than 01 month then we must think that he have family also.
According to me ( as i am doing this practice in my company) if it was a normal case then we talked about rules and regulations but in this condition i never do that. i just want to help the employee at any cost.
because employee is first a human.
