My query to all is the following:
The Minimum wage for Shops and Establishment is the following:
Zone I
Basic Special Allowance Total
Skilled 5800 + 1576.8 = 7377
Semi Skilled 5400 + 1576.8 = 6977
Un Skilled 5000 + 1576.8 = 6577
Kindly clarify- The Basic salary/wage for all employees whether executive/technical service staff should have minimum basic as provided above? It was also mentioned that in Maharashtra, HRA (MINIMUM 5% of basic) should also be included. Does that mean all skilled employees will have gross salary of Rs.7667/-, semi skilled Rs. 7247/- and unskilled employees Rs.6827/-. The aforesaid gross salaries include 5% HRA.
I am slightly confused as I have come across some companies coming under shops and establishment- having basic much lesser-2500,3500 etc. Rs. 5800/- is on a higher side as above this gross, the company will incur cost on PF,ESIC, Bonus etc. This will increase the CTC. As per this calculation taking minimum bonus of Rs. 3500/-, employee/ technical staff CTC will not be less than Rs.100000/- approximately.
Am I right? Please correct me if I am wrong.

If employee basic 8800 HRA 3325 spec 880 TRA 1375 PP 850 = 15230 (total gross) , but if their is a deduction of loan of Rs7600/- and other deduction like PT / PF and his salary becomes 6500/- does he would fall under minimum wage act as per provided slab for Engineering firm

As per Minimum Wages Act, the employees GROSS SALARY should be equivalent or more than basic + special allowance+ hra( 5% of basic applicable in some states) slab provided by them. The total gross salary -Rs. 15230/- is much higher than the slab provided by the Engineering sector.
Moreover the salary figure you arrive at after deductions is the net salary and the Minimum Wages Act only mentions the gross salary to be paid to skilled,semi skilled and unskilled employees in a particular industry.
