You all are requested to please clarify my doubt.
My doubt is, suppose any organization have some part-time employees who are getting 8k to 12k for 2-4 hours. Now, if the organization is covered under ESI Act, then what will be the responsibilities of the Employer on their behalf? Are they all will be covered under the ESI, as they are getting less that 15,000/-, which is wage ceiling for ESI.
Plz. help me in this regard.

Dear Bhuwan,
Any employee who is is working in a covered establishment is eligible for ESI if his/her wages is below 15,000/-.
He/she may be temporary, part-time or full time should be covered under ESI.
Any person who has worked for even 1 day in a covered establishment should be covered under ESI.
All those persons employed for wages drawing an amount within the wage ceiling employed in clerical, manual, skilled, semi-skilled, unskilled without distinguishing casual, temporary, technical & non-technical are to be covered.

It is not compulsory to cover Part time employees if they are getting more than 15000/- rupee per month. As such these part time employees are getting 8000-12000 rupees for 2-4 hours and if you have specific appointment clause to this effect and if the monthly salary is under the limit of Rs. 15000/- per month, obviously ESI Contribution is required to be paid. In case of specific agreement where in working hours are fixed and the these employees are working with some other establishment in rest of the hours and they are showing their salary received from the other management and are paying income tax, these will be treated as an exempted employee. Specific conditions apply.

Show the employee who is working in part time and how much hrs he is working, as a hours basis pay the consolidated amount to him. And don't consider him as a employee, and pay the remuneration as a expenses as what is his nature of work. by cash or bank voucher and it should be accountable in the head of other than salary and wages. for the part time employees name should not be reflect in the "Register of Regular Muster Roll" of the company.... kindly note.
