I dont have full rights to generate letters such as offer letter etc.an employee just used slang words & comments while telephonic conversation bcoz he is not receiving any experience letter or acceptance of his resignation. And I have been stirctly instructed by M.D. that not to issue any kind of letter to anyone and always take permission before doing so. as junior level employee i accepted this but this employee said M.D. told me that you have full rights etc. and why you are doing so??
In addition i dont even have printer to generate any letters or any internet connection to use even if i asked for it so many times.
if i exclude this my overall experience ws good here but i found many other employees are not happy with management and it includes me too even if i dnt have such decision making authority.
what should i do if it happens again is it noramal & comman among other org. too.
(the employee mentioned here has not given any notice period to company thats why M.

If you had rights also, you cannot issue any letter until and unless your MD gives you approval for the same.
Secondly, if the said employee has not given notice period, tell him clearly that you will not issue him any letter.
Communicate everything to your MD and also to the employee.

More important thing is to always favor your MD as he is your senior another thing is that your MD is the person due to whom you are getting all facility weather less or more and another serious matter to discuss is that..it was your will that you joined this company-nobody forced you to join. Mayour Shinde's massage to Communicate everything to your MD is the first thing to do.Never ever think that he does not gives authority to you...my dear frnd it his mercy that you are still in his company even you are discussing or even giving a lough or a little smile when some one shares negative about your MD.

My friend concentrate on your task without thinking of prestige etc, these office has a very bad politics so be diplomatic in office.

The result will be in your hand within 5-6 months.

Your problem is the issue related to company policies.Your MD and other seniors in the company are the people who will guide you through if you discuss with them and seek proper approvals and sanctions through proper channels.You are in HR and HR Field is more than authority and rights.Pls Perform and you will get everything in right time.EGO is the biggest enemy, do not carry.Let us learn professionism and ethical practices in industry.

From your post I can summarize only two valid Points:

Using Slang Words / Comments on phone : Police Complaint Employee cooling heels in Jail.

Not Giving Experience Certificate: MD / Company / Management has proper reason that employee did not serve Notice Period.

I feel you are not mature enough to be in HR, in your post itself you have mentioned the reason why MD not giving Experience Letter. And you have totally gone off the track like telling i dont have internet and i dont have printer which literally makes me laugh anonymous.

All you have to do is quote the rule to employee, the rule which mentions the notice period and since he has not followed the documented company policy the company cant issue Experience Letter. We all are representatives of Company and the Company a non living entity exists on the decisions made by us, so we should only follow the documented rule instead of thinking why MD is not giving Experience Letters. If every rule is followed and MD / Management does not have any valid reason to withhold experience letter still if they do means some personal enimity between MD and Employee this also has to be dealt with some maturity, which differs from case to case.

Well some Topmost Management personnel often use HR as a source to 'off-load their own blame'. This is common especially in private sector & smb where there is insecurity among employees including HR. Many a times, HR becomes bali-ka-bakra and is helpless as people just won't believe them. The facilitator role of HR between Management and Employees is seen differently by different groups. Management feel HR is their servant and Employees feel HR is the Management (aka chamcha). Both notions are wrong and it would take tact and diplomacy by HR to pass safely through this narrow gap in-between Management and Employees. The best part is to bring in the reporting supervisor of the concerned employee into play. if the reporting supervisor is the MD himself, then get him involved. You can explain to the employee to subject to approval of MD, you are willing to cooperate with the employee regarding the exp letter. Tell the Employee to sort out his/her differences with the MD and meet him personally. Make him understand as you are working under instructions. There is no need to doubt that you-the HR is holding back letters as you are not authorized to do so, and moreover, since you are not the reporting supervisor, there is no good reason why you should hold back exp letter of anyone for that matter. Don't over explain. If employee understands- well and good. If not- forget it. Let him think whatever- maybe abuse or threat or anything- this might infact strengthen your resolve not to give him the letter. Part and Parcel of being HR. Experience will teach you to move over.

It is nothing unusual about your MD\'s instructions to you, your exiting colleague\'s arguements, your inability to do or not to do anything as you described in your post. This is the same case almost every where including, govt. or private. You may be surprised even in Proprietorship firm also such things happens.
So don\'t feel sorry for yourself. You\'ll get accustomed for such situations soon.Don\'t forget- Boss is Boss.
