Dear seniors,
We are 100 count of employees and 2.5 years old company. I am aware that company is liable to pay the gratuity, one complete the Five years of continuous services at the time of retirement or leaving the organization.
Further, I would like to know whether we have to register the same with Labour welfare department by furnishing necessary forms though company is not complete Five years of operations as of today.
Furthermore, kindly clarify, Do we have to submit employee nomination forms (Form # F) to Labour welfare Department or any Government body?
I request you all kindly give your valuable views for better understanding.

Employer need not submit the nomination forms to the Controlling authority/labour Commissioner but keep it on record. B.Saikumar HR & labour Law Advisor Mumbai

Dear TSK,
Definitely U have to submit Form-A (Notice of Opening) to your Concerned Lab-our Department, and for the employees Form-F,Statutory it has to be submitted within 30 days, after completion of 1 year.

Hi TSK
There is no registration required if you have already register with Shops & Commercial Act / Factory Act, and need to take a nomination Form F from the employees who completed the 5 years 1 day in the same organisation. and keep for your record in his personal file or gratuity file.
